TERMS OF SERVICE

OVERVIEW

This website is operated by Morningstar Chandlery. Throughout the site, the terms “we,” “us,” and “our” refer to Morningstar Chandlery.

Morningstar Chandlery offers this website, including all information, products, services, features, and tools available through this site, conditioned upon your acceptance of these Terms of Service.

By visiting our website, purchasing a product, placing an order, or otherwise using our services, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping & Delivery Policy, Return & Replacement Policy, and any other policies posted on our website.

Please read these Terms carefully before using the website.

If you do not agree with these Terms, please do not use the website or purchase products from Morningstar Chandlery.

We reserve the right to update or modify these Terms from time to time. Changes become effective when posted to the website unless otherwise stated.

SECTION 1 — ONLINE STORE TERMS

By using this website, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or that you are using the website with appropriate authorization.

You may not use our products or services for any unlawful or unauthorized purpose.

You may not use this website in a manner that violates applicable federal, state, or local laws or regulations.

You may not transmit viruses, malicious code, or other material intended to interfere with the operation or security of the website.

We reserve the right to refuse service, restrict access, cancel orders, or terminate use of the website when reasonably necessary to protect Morningstar Chandlery, our customers, our service providers, or the integrity of our store.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service or cancel an order when reasonably necessary, including in circumstances involving suspected fraud, payment issues, abusive conduct, pricing errors, unauthorized resale activity, or violation of these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of the website, products, branding, photographs, designs, written content, or services without our written permission.

Headings used in these Terms are provided for convenience and do not limit or otherwise affect the meaning of these provisions.

SECTION 3 — ACCURACY OF INFORMATION

We make reasonable efforts to ensure that information presented on the website is accurate and current.

However, occasional typographical errors, inaccuracies, omissions, outdated information, or technical errors may occur.

We reserve the right to correct errors, update information, or modify website content at any time without prior notice.

Nothing on the website should be relied upon as professional, medical, legal, or other specialized advice.

SECTION 4 — PRODUCTS, PRICING, AND AVAILABILITY

All products are subject to availability.

We reserve the right to:

  • Change product prices
  • Modify product descriptions
  • Discontinue products
  • Limit quantities
  • Limit sales to particular persons, households, geographic regions, or jurisdictions when reasonably necessary
  • Correct pricing or product-information errors

Prices are displayed in U.S. dollars unless otherwise stated.

Placing an item in your shopping cart does not reserve the product.

An order is not guaranteed until payment has been accepted and the order has been confirmed.

If a pricing or product-information error affects an order, Morningstar Chandlery may contact the customer to resolve the issue or cancel and refund the affected order when appropriate.

SECTION 5 — HAND-POURED CANDLE CHARACTERISTICS

Morningstar Chandlery candles are hand-poured products.

Because of the handmade nature of our candles, minor variations may occur between products or batches.

These may include variations in:

  • Wax appearance
  • Surface texture
  • Color
  • Label placement
  • Glass adhesion
  • Frosting
  • Wet spots
  • Appearance caused by temperature changes

Minor cosmetic variations that do not affect the safe use or expected performance of a candle are not necessarily defects.

Product photographs are intended to represent our products as accurately as reasonably possible. However, colors and other visual details may appear differently depending on lighting, photography, screen settings, or device displays.

SECTION 6 — FRAGRANCE EXPERIENCE

Fragrance perception is subjective and may vary from person to person.

Factors including room size, airflow, temperature, individual scent sensitivity, and candle-care practices can affect fragrance perception and performance.

Product descriptions are intended to describe the general fragrance profile and character of each candle but do not guarantee that every customer will experience a fragrance in exactly the same way.

Dissatisfaction based solely on personal fragrance preference, fragrance strength preference, or a change of mind does not qualify for a return, exchange, refund, or replacement under our standard policy.

Please review fragrance descriptions carefully before purchasing.

SECTION 7 — CANDLE SAFETY AND CUSTOMER RESPONSIBILITY

Candles involve an open flame and must be used responsibly.

Customers are responsible for following the candle-care and safety instructions provided with the product or on our website.

Among other precautions, customers should:

  • Never leave a burning candle unattended
  • Keep candles away from children and pets
  • Keep candles away from drafts and flammable materials
  • Place candles on stable, heat-resistant surfaces
  • Trim the wick as instructed
  • Follow recommended burn-time limits
  • Discontinue use when the remaining wax reaches the recommended stopping point
  • Never move or handle a candle while the wax or container is excessively hot

Improper candle use may create a risk of fire, burns, property damage, or personal injury.

If a candle appears damaged or unsafe, discontinue use immediately and contact Morningstar Chandlery.

Nothing in this section limits any responsibility or liability that cannot lawfully be excluded.

SECTION 8 — ORDERS AND BILLING INFORMATION

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all orders.

You are responsible for reviewing your order before submitting payment.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including orders that appear fraudulent, unauthorized, unusually large, intended for unauthorized resale, or affected by an obvious pricing or inventory error.

If we make a change to or cancel an order after payment has been processed, we will make reasonable efforts to notify you using the contact information provided with your order.

SECTION 9 — SHIPPING AND DELIVERY

Order processing times, shipping procedures, tracking information, address responsibilities, carrier delays, damaged shipments, and other delivery matters are governed by our Shipping & Delivery Policy.

Shipping and delivery estimates are estimates unless expressly stated otherwise.

Morningstar Chandlery is not responsible for delays caused solely by shipping carriers, weather events, transportation disruptions, incorrect customer-provided addresses, or other circumstances outside our reasonable control, except where applicable law provides otherwise.

Customers are responsible for providing an accurate and complete shipping address.

SECTION 10 — RETURNS, REPLACEMENTS, AND DAMAGED PRODUCTS

Morningstar Chandlery’s standard policy is that all sales are final, except for qualifying products that arrive damaged or where another remedy is required by applicable law.

We do not normally accept returns, exchanges, or refunds based on:

  • Fragrance preference
  • Fragrance-strength preference
  • Change of mind
  • Ordering the wrong fragrance or item
  • Preference for another product
  • Products that have already been burned or used

Products received broken, cracked, severely damaged, or otherwise unusable due to qualifying delivery damage may be eligible for replacement according to our Return & Replacement Policy.

Damage claims must be reported within the timeframe and with the documentation specified in that policy.

Where a qualifying damage claim is approved, Morningstar Chandlery’s standard remedy is replacement of the same product, subject to availability.

Nothing in these Terms or our Return & Replacement Policy is intended to eliminate any legal right or remedy that cannot lawfully be waived.

SECTION 11 — ORDER CANCELLATIONS

Orders begin processing shortly after they are placed.

Cancellation requests are therefore not guaranteed.

Customers should contact Morningstar Chandlery as soon as possible after placing an order if a cancellation is requested.

Once an order has been fulfilled or transferred to the shipping carrier, the order generally cannot be canceled under our standard policy.

Any rights required by applicable law remain unaffected.

SECTION 12 — GIFT CERTIFICATES AND GIFT CARDS

Gift certificates or gift cards purchased through Morningstar Chandlery may be subject to additional terms presented at the time of purchase.

Gift certificates:

  • Have no cash value except where required by law
  • May not ordinarily be redeemed for cash
  • Must be used toward eligible purchases from Morningstar Chandlery
  • Should be treated like cash because anyone possessing valid gift-certificate information may potentially be able to use it

Customers are responsible for safeguarding gift-certificate information.

Morningstar Chandlery is not responsible for unauthorized use resulting from a customer’s disclosure or loss of gift-certificate information except where required by law.

SECTION 13 — OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, services, payment processors, applications, social-media features, or other technology operated by third parties.

Your use of third-party services may also be governed by the terms and privacy policies of those third parties.

Morningstar Chandlery does not control every aspect of third-party services and is not responsible for circumstances outside our control except where applicable law provides otherwise.

SECTION 14 — THIRD-PARTY LINKS

The website may contain links to third-party websites.

These links are provided for convenience or informational purposes.

Morningstar Chandlery does not control and is not responsible for the content, policies, security, availability, or practices of independent third-party websites.

Customers should review the applicable policies of third-party websites before providing personal information or completing transactions with those parties.

SECTION 15 — INTELLECTUAL PROPERTY

Unless otherwise indicated, the content associated with Morningstar Chandlery, including our brand name, product names, photographs, graphics, written copy, designs, logos, product presentation, website content, and other original creative materials, belongs to Morningstar Chandlery or is used with permission.

You may view and use the website for personal shopping and informational purposes.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or create unauthorized derivative works from our protected content without prior written permission.

Nothing in these Terms grants ownership rights in Morningstar Chandlery intellectual property.

SECTION 16 — CUSTOMER CONTENT AND COMMUNICATIONS

If you voluntarily submit reviews, photographs, feedback, testimonials, comments, suggestions, or other content to Morningstar Chandlery, you represent that you have the right to submit that material.

You may not submit unlawful, threatening, defamatory, obscene, fraudulent, infringing, or malicious content.

We reserve the right to remove or decline to publish customer-submitted content when reasonably necessary.

Private communications involving customer-service matters will be handled in accordance with our Privacy Policy and applicable law.

SECTION 17 — PERSONAL INFORMATION

Personal information submitted through the website is governed by our Privacy Policy.

Our Privacy Policy describes how information may be collected, used, disclosed, stored, and otherwise handled in connection with our store and the services that support it.

SECTION 18 — PROHIBITED USES

You may not use the website or its content:

  • For unlawful purposes
  • To solicit unlawful activity
  • To violate applicable laws or regulations
  • To infringe intellectual-property rights
  • To harass, threaten, abuse, or discriminate against others
  • To provide false or misleading information
  • To transmit malicious software or code
  • To interfere with website security
  • To collect personal information about others without authorization
  • To engage in fraudulent purchasing activity
  • To interfere with the operation of Morningstar Chandlery or our service providers

We reserve the right to restrict or terminate access for violations of this section.

SECTION 19 — ERRORS, INACCURACIES, AND OMISSIONS

From time to time, the website may contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, availability, shipping information, promotions, or other content.

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary.

If an order is canceled after payment has been collected because of an error attributable to Morningstar Chandlery, the appropriate payment amount will be refunded.

SECTION 20 — DISCLAIMER OF WARRANTIES

We make reasonable efforts to provide accurate information, quality products, and reliable website services.

However, except for warranties, rights, or remedies that cannot legally be excluded or limited, the website and services are provided on an “as available” basis.

We do not guarantee that the website will always operate uninterrupted, error-free, or without technical problems.

Nothing in these Terms excludes or limits any warranty, consumer right, or remedy that cannot lawfully be excluded under applicable law.

SECTION 21 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Morningstar Chandlery will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website or circumstances outside our reasonable control.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms is intended to limit liability for conduct or circumstances for which limitation is prohibited by applicable law.

SECTION 22 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Morningstar Chandlery harmless from third-party claims, liabilities, losses, or reasonable expenses resulting directly from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse of our products.

This provision does not apply to the extent a claim results from conduct for which Morningstar Chandlery is legally responsible.

SECTION 23 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be treated as severed from these Terms.

The remaining provisions will continue in effect.

SECTION 24 — TERMINATION

These Terms remain effective unless terminated by you or Morningstar Chandlery.

You may stop using the website at any time.

Morningstar Chandlery may suspend or terminate website access when reasonably necessary because of fraud, unlawful conduct, security concerns, abuse, or a material violation of these Terms.

Obligations and liabilities incurred before termination survive to the extent necessary to give them effect.

SECTION 25 — ENTIRE AGREEMENT

These Terms, together with the policies and information incorporated into them by reference, constitute the agreement governing your use of the Morningstar Chandlery website and services.

The failure to enforce a particular provision on one occasion does not constitute a waiver of that provision.

SECTION 26 — GOVERNING LAW

These Terms of Service and any separate agreements through which Morningstar Chandlery provides products or services shall be governed by and construed in accordance with the applicable laws of the State of Louisiana and the United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this provision limits any consumer protection or other rights that applicable law requires to be governed by another jurisdiction.

SECTION 27 — CHANGES TO THESE TERMS

We reserve the right to update, modify, or replace these Terms of Service by posting revised Terms on our website.

Customers are encouraged to review this page periodically.

Continued use of the website after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
